Artees – Terms of Service & Conditions

1. Introduction & Acceptance of Terms

Welcome to Artees. These Terms of Service and Conditions (“Terms”) govern your access to and use of our website, services, quotes, invoices, and products.

By accessing our website, placing an order, approving a quote, or accepting an invoice, you agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific services or features.

You affirm that you are of legal age to enter into this agreement. If you are using our services on behalf of a company or other organization, you represent that you have the authority to bind that entity to these Terms.

Any modifications to these Terms must be agreed to in writing by both parties.

2. Privacy

By using our services, you consent to the collection, use, and disclosure of personal information as outlined in that policy.

3. Access and Use of Services

You are granted a limited, non-exclusive, non-transferable right to access and use our website and services for lawful purposes only.

You agree not to:

Attempt unauthorized access
Introduce malicious code or viruses
Disrupt or interfere with our systems
Use our services for illegal or fraudulent purposes

We reserve the right to suspend or terminate access for violations of these Terms.

4. Quotes & Estimates

All quotes are valid for 30 days unless otherwise stated.
Prices may change if artwork, garment specifications, quantities, or timelines are revised.
Quotes do not reserve inventory or production capacity until approved and paid per payment terms.

5. Order Approval

A signed approval and/or required deposit is mandatory before production begins.
Digital mockups are provided for approval; production proceeds exactly as approved.
Errors or omissions in approved artwork are the client’s responsibility.

6. Minimum Order Quantities

All orders must meet the minimum quantities specified in the quote or invoice.

7. Turnaround Time

Production timelines begin after artwork approval and required payment are received.

Typical production times:

Screen Printing: 7–10 business days
Embroidery: 10–14 business days
DTF Transfers: 5–7 business days

Turnaround times are estimates and not guarantees.

8. Rush Orders

Rush orders must be requested in writing and approved based on capacity.
Rush fees:

25% for orders under 5 business days
50% for orders requiring 3 business days or less

Expedited shipping costs are the client’s responsibility.

9. Artwork Requirements & Revisions

Artwork must be print-ready (AI, EPS, PSD, or PDF at 300 DPI).
Additional charges may apply for artwork preparation or modification.
Up to 3 revisions are included.
Additional revisions are billed at $25 per revision.

10. Pricing, Fees & Payment Terms

Prices are listed in U.S. dollars and subject to change.
Prepayment is required at order placement unless otherwise approved.
Remaining balances are due upon order completion.
Approved credit accounts may receive net terms.
Late payments incur a 1.5% monthly fee.
We reserve the right to cancel or suspend orders for non-payment.

Artees does not guarantee credit terms and may revoke them at any time.

11. Inventory & Availability

Inventory availability is not guaranteed. If a product becomes unavailable after order placement, we will notify you and offer substitutions or a refund.

We reserve the right to discontinue products without notice.

12. Cancellations & Changes

Orders canceled after approval may incur charges for labor, materials, and incurred costs.
All changes must be submitted in writing and may incur additional fees.

13. Overruns & Underruns

An overrun or underrun of up to 2% may occur. Clients will be billed for the actual quantity shipped.

14. Defects & Claims

Claims must be submitted in writing within 5 business days of receipt.
Artees may replace or issue credit at its discretion.
No claims will be accepted after garments are worn, washed, or altered.

15. Client-Supplied Materials

Artees is not responsible for defects or damages to client-supplied items.
Clients must inspect and approve their goods prior to production.
Artees is not responsible for missing client-supplied items.

16. Intellectual Property

Clients represent that they have the legal right to use all artwork, logos, and trademarks provided.

Clients agree to indemnify and hold Artees harmless from all claims related to intellectual property infringement.

All website content remains the property of Artees and may not be reproduced without written permission.

17. Third-Party Services

Artees is not responsible for third-party websites, platforms, shipping carriers, or services. Use of third-party services is at your own risk.

18. Disclaimer of Warranties

All services are provided “as is” and “as available.”
Artees disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

19. Limitation of Liability

To the fullest extent permitted by law:

Artees shall not be liable for indirect, incidental, or consequential damages.
Total liability is limited to the amount paid for the applicable order.

20. Indemnification

You agree to indemnify and hold Artees harmless from any claims, damages, or expenses arising from:

Use of our services
Distribution or resale of printed materials
Violation of these Terms

21. Termination

We may suspend or terminate access or services at any time for violation of these Terms. Obligations incurred prior to termination remain enforceable.

22. Governing Law

These Terms are governed by the laws of the State of Florida, and any disputes shall be resolved in Florida courts.

23. Entire Agreement

These Terms constitute the entire agreement between you and Artees and supersede all prior agreements.
